These Terms and Conditions of Sale and Use (the "Terms") set out the terms under which 10.9 ("the Platform") makes its services available to users ("User" or "you"), whether free or paid. They supplement the Legal Notice, which alone identifies the publisher and the hosting provider.
This website is published by an individual acting in a non-professional capacity, whose full identity is kept confidential by the hosting provider, in accordance with the Legal Notice. These Terms apply to every visitor and every registered User of the Platform.
Creating an account on the Platform, and any use of the services offered (free or paid), constitutes full and unconditional acceptance of these Terms. If you do not accept them, you must not use the Platform.
3.1 Free services: access to editorial content, creation and tracking of shooting sessions, personal equipment management, browsing the professional directory, publishing classified ads (subject to moderation, Article 7), and private messaging between users.
3.2 Paid offer: in addition to the free offer, the Platform proposes one or more paid plans giving access to additional features. The list of plans, their content, pricing, and duration in force are set out on the pricing page accessible from the home page; these details are authoritative and may change, without any retroactive effect on a subscription already in progress.
4.1 Registration on the Platform requires only the creation of a username and a password. Consistent with 10.9's privacy-first approach, no real identity data (name, surname, email address) is required to create or use an account.
4.2 Each User has a public identifier (an "alias"), which alone is visible to other users; the publisher undertakes never to publicly expose real identity data linked to an account.
4.3 The User is solely responsible for keeping their login credentials confidential and for any action performed from their account.
This article describes how the Platform's electronic wallet ("PME" or "Wallet") works. The Wallet is being rolled out progressively: the provisions below apply only once the corresponding feature is actually enabled on the User's account, as indicated within the application.
5.1 Nature of the Wallet. The Wallet is an internal credit, specific to each account, usable exclusively within the Platform to pay for 10.9's paid plans. It is not a bank account, not a payment instrument usable outside the Platform, and not a means of transferring funds between users. The balance may not be transferred to a third party, assigned, or converted into cash.
5.2 Top-ups. The User may top up their Wallet by credit card, in fixed amount tiers offered within the application, via the payment provider Stripe. A recurring top-up (based on 3, 6, or 12 months of subscription) may also be set up; the amount and frequency chosen when setting up a recurring top-up remain fixed until changed or cancelled by the User.
5.3 Cap. The Wallet balance is capped at โฌ100 per account. Any top-up attempt that would take the balance above this cap is refused or adjusted before any charge is made; no payment is ever taken beyond the applicable cap.
5.4 Use of the balance. The Wallet balance is used exclusively to pay for the Platform's paid plans, by automatic deduction at each subscription due date. This deduction never generates a referral commission (Article 6).
5.5 No refunds. Except where mandatory law provides otherwise, amounts credited to the Wallet are non-refundable, including in the event of non-use, subscription cancellation, or account deletion. By confirming a top-up (one-off or recurring), the User expressly requests immediate performance of the corresponding digital service โ the credit becoming immediately available in their Wallet โ and acknowledges, in accordance with Article L221-28, 13ยฐ of the French Consumer Code, thereby waiving their 14-day right of withdrawal provided for in Article L221-18 of the same Code for distance contracts.
5.6 Insufficient balance. If the balance is insufficient when a subscription payment falls due, the User is notified and has 15 days to top up their Wallet before access to the paid plan is suspended. If the balance is still insufficient at the end of this period, access automatically reverts to the free plan, with no loss of the User's data.
5.7 Transparency of the bank transaction. Topping up the Wallet by credit card results in a standard bank transaction between the User and 10.9, visible to the User's bank on their account statement, as with any online purchase. This transaction is not covered by the Platform's anonymity policy, which applies only to shooting data and to the identity displayed within the application. Payment is processed by Stripe in accordance with its own privacy policy; 10.9 does not store any cardholder data or billing information in its database.
5.8 Account deletion. Deleting an account results in the permanent loss of the associated Wallet balance, with no refund (Article 5.5).
This article describes the referral programme, which relies on the Wallet described in Article 5 and follows the same progressive rollout.
6.1 Principle. Every account has a personal referral code. A new user may enter this code at registration to establish a referral link with the code holder (the "sponsor"). This link is set once, at account creation, and can never be changed afterwards. Entering an invalid or non-existent code never prevents account creation.
6.2 Welcome credit. Creating an account via a valid referral code triggers a one-off credit of โฌ0.50 to the sponsor's Wallet.
6.3 Ongoing commission. For the 18 months following the referred user's account creation, each real-money top-up made by the referred user (excluding referral credits) triggers payment to the sponsor of a commission equal to 10% of the amount topped up. This commission is paid only to the direct sponsor; it is never calculated on amounts spent by the referred user, nor on a referral credit. Beyond 18 months, no further commission is generated; the welcome credit, however, remains permanently acquired.
6.4 Fair use. 10.9 reserves the right to suspend an account's participation in the referral programme in the event of proven fraud or any attempt to circumvent the rules above, including creating multiple accounts for the sole purpose of generating commissions.
7.1 Every classified ad published is subject to prior moderation and is only visible to other users once approved; 10.9 may refuse or remove an ad at any time, in particular where it does not comply with these Terms or applicable regulations.
7.2 Transactions arising from a classified ad are concluded directly between the selling User and the buying User. 10.9 is not a party to any such transaction, does not process its payment, and makes no guarantee as to the quality, conformity, or legality of the items offered โ responsibility for this rests exclusively with the users concerned, in compliance with regulations applicable to the sale of firearms and shooting equipment.
8.1 Private messaging must be used with respect for others and applicable regulations. Insulting or discriminatory remarks, unlawful content, and unsolicited commercial messages are prohibited.
8.2 Any User may report content or conduct that breaches these Terms. 10.9 reserves the right to suspend or delete, without notice, any account responsible for a serious or repeated breach.
Unless stated otherwise, the Platform's elements (structure, visual identity, editorial text) are the property of the publisher. Content posted by users (target photos, ad text, messages) remains their property; by publishing it on the Platform, the User grants 10.9 the right to host, store, and display it solely to the extent necessary for the service to operate.
10.1 10.9 endeavours to provide continuous access to the Platform but does not guarantee uninterrupted availability (maintenance, technical incidents, force majeure). A partial offline mode allows sessions to continue to be recorded without network access; synchronisation with the server occurs as soon as the connection is restored.
10.2 10.9 cannot be held liable for indirect damages resulting from use of, or inability to use, the Platform.
The processing of personal data is described in the Legal Notice, section "Personal Data & Cookies", which forms an integral part of the contractual framework applicable to the User.
12.1 The User may request deletion of their account at any time.
12.2 If a sponsor's account is deleted, the accounts of their referred users are not affected in their use of the Platform; they simply stop generating any commission for that sponsor (Article 6.3).
12.3 Deleting an account does not give rise to any refund of the Wallet balance (Articles 5.5 and 5.8).
10.9 reserves the right to amend these Terms at any time, in particular to reflect regulatory or functional changes. The applicable version is the one published on the Platform at the time the service is used, with the last-updated date shown at the top of this document. Users will be informed of any substantial change affecting paid services.
These Terms are governed by French law. In the event of a dispute, a consumer User may make free use of a consumer mediator, under the conditions set out in Articles L616-1 et seq. of the French Consumer Code, before bringing any court action.
